Welcome to Milky Makers. These are the terms and conditions governing your access to and use of the website www.milkymakers.com. By accepting these terms and conditions (including the linked information herein), and by using the Site, you represent that you agree to comply with these terms and conditions with Al Accad Department Stores (trading as Milky Makers) (“we”, “us” or “Milky Makers”) in relation to your use of the Site (the “User Agreement”). This User Agreement is effective upon acceptance. If you do not agree to be bound by this User Agreement please do not access, register with or use this Site. Before you may become or continue as a member of the Site, you must read, agree with and accept this User Agreement and Milky Makers’s Privacy Policy (the “Privacy Policy”). You should read this User Agreement and the Privacy Policy and access and read all further linked information referred to in this User Agreement, as such information contains further terms and conditions that apply to you as a user of Milky Makers. Such linked information including but not limited to the Privacy Policy is hereby incorporated by reference into this User Agreement.

We reserve the right to change and amend these terms and conditions. Any changes we make will be deemed to have come into effect on the date that they have been posted on the website. You are responsible for reading the terms and conditions. When you place an order with us you will be deemed to have read, understood and accepted these terms and conditions.

Trading licence:
Trading License: Al Accad Department Stores is a sole proprietorship, and is a fully licensed company trading as Milky Makers, a locally registered company governed by the laws of the UAE. All receipts, invoices and payment details will be made through Al Accad Department Stores.

Online shopping:
Become a member on the site?
In order for us to deliver to you, you will need to become a member of the Milky Makers website. All your details will be treated with the utmost privacy and security. Security is very important to us.

We will require your delivery address, your contact and payment details. We will then give you an account number and ask you to set a password for your account. Please make sure your details are kept somewhere you can remember as this will help us to locate your account if you call or email us.

Once your account has been set up, you’ll be able to view your order summary again in your ‘shopping cart’ page.
 

Online orders:
All orders submitted through our www.milkymakers.com website are confirmed by e-mail. No order should be deemed to be accepted without this confirmation. All orders are fulfilled subject to these terms and conditions. It might not be possible for us to accept orders for delivery to certain areas; in this case collection must be made from our stores or from a pre-arranged

 

pick-up point.

All orders are subject to availability. Should any of the items be out of stock at the time of placing your order, you will be notified via email and we will suggest an alternative if possible. Alternatively you will be offered a refund for this item (see refunds and returns).
 

Delivery:
Normal delivery times are 9am – 6pm Saturday to Thursday. The day of delivery will depend on where you live. We have different delivery days for different areas so please check the website for the days on which we can delivery in your area. You are always welcome to arrange for pick-up at one of our stores.

• DUBAI: Delivery is free for orders above Dhs250. For orders below Dhs250 we charge a Dhs50 delivery fee. We deliver to specific areas on pre-defined days. Your order must be placed before 5pm two days before the delivery day in order for us to be able to deliver.

• ABU DHABI: at the moment we can only offer delivery for orders above AED1,000. We have two collection points in Abu Dhabi or behind the Etisalat building. We now also offer a pickup point behind Mushrif Mall.

• AL AIN: we currently only have a pick-up point in Al Ain, by Jimi Mall on Sundays.

• OMAN: we offer a delivery service twice a month to Oman through a local partner. Dates are confirmed on the website. There is a collection point as well as limited home delivery where a fee may apply.

We currently deliver to the following areas but are always looking to expand:

• DUBAI : Al Barsha, Araabian Ranches, Al Safa, Al Wasl, Burj Khalifa, Business Bay, Desert Palm, Downtown Dubai, Dubai Marina, Emirates Hills, Internet City, JBR, JLT, Jumeirah 1,2,3, Jumeirah Islands, Jumeirah Village Circle, Jumeirah Village Triangle, Knowledge Village, Media City, Old Town, Palm Jumeirah, Tecom, The Gardens, The Greens, The Lakes, The Meadows, The Springs, The Views, The Villa, Umm Suqeim 1,2,3, Victory Heights

• STORE PICK UP POINTS: Sheikh Zayed Road, The Greens, Village Mall

 

Payments and refunds

We offer two methods of payment:

• Online payment through our secure payment gateway (Mashreq bank)

You are now able to pay online for your purchases: we accept Visa and Mastercard. When you opt to make an online payment for your purchases, you will only be charged for the items which will be delivered. Upon confirmation of your order, you will receive a confirmation email with the items purchased. We will contact you to confirm a delivery time and date, as well as your final order (should there be any missing items). A final confirmation email will be sent to you with the final amount and confirmed items to be delivered. This is the amount that will be charged to your credit card.

Any cancellations of orders paid for online need to be made in writing within 24 hours. Your card will then not be debited and the cancellation of the purchase will appear in your next bank statement. Terms and conditions will vary according to YOUR payment card. There are no charges from OFC.

• Payment by cash or credit card on delivery (the customer needs to be present to sign the receipt).

If you are not at home, payment must be left in a secure place for the driver to collect, or with a designated person. Payment will still be requested if you are not available to collect your order.
 

Currency:
Prices quoted are in UAE Dirhams and all payments are to be made in UAE Dirhams.
Refunds, returns and stock availability:
Non-perishable items can be returned in an Milky Makers shop within one week (with receipt).We cannot offer refunds for fresh produce. No baby food or perishables can be returned.

At Milky Makers we will work hard to only deliver the freshest and best products, and to keep the items on the website up to date. Due to the nature of Organic foods, and the fact that we work with small family suppliers, some items may no longer be available between the time of order and the time of delivery.

Should a product no longer be available between the time of placing your order and the time of delivery, we will contact you by email to offer alternatives. Should you not wish to receive an alternative we will amend the order, and your receipt, prior to

delivery.

 

Privacy policy and Website Content

Privacy and Security Policy:
Milky Makers is committed to protecting customers’ privacy and ensuring that all transactions are processed with utmost security. Milky Makers does not store any credit/debit card information on its servers or database, all details will be processed to the payment gateway directly. Personal information will only be asked to ensure efficient processing of your order and will be saved in a secure database within Milky Makers. Milky Makers does not sell, trade, or rent any personal information to outside parties unless otherwise compelled by the law.

The security and privacy of your personal information is very important to us at Milky Makers. We recognize that security is a major concern among on-line shoppers, and thus we employ state-of-the-art data encryption technology to protect the personal information submitted to us, both during transmission and once received.
 

Customer Information:
Other personal data; such as your login details, home address, e-mail and billing information, are stored in a highly secure systems to ensure that all information you provide us with remains fully protected. Only those with proper authorization can view this data.

Passwords are stored on our servers using one-way encryption systems. We use SHA512 (Secure Hash Algorithm) – which is a cryptographic hashing algorithm that is considered unbreakable.
 

Vouchers:
Please register on the website to use the vouchers. Online vouchers are valid only for the duration speficified on the campaign, for new customers only, and only for one purchase. Vouchers cannot be used in the shops, only online. The discount applies to online purchases, exclusive of delivery charge if applicable. A delivery charge of 50dhs applies for orders below 250dhs in Dubai. Vouchers are not applicable for customers in Oman.

We make no warranty that the Milky Makers website will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the site or the server that makes it available is free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Milky Makers website. You acknowledge that we cannot guarantee and therefore shall not be in any way responsible for the security or privacy of the Milky Makers website and any information provided to or taken from the Milky Makers website by you.
 

Other Conditions:
We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for: any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or any loss of goodwill or reputation; or any special or indirect or consequential losses; In any case whether or not such losses were within the contemplation of the parties at the date of the Conditions, suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions. Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.
